These Terms and Conditions govern your use of Whelair's luxury car rental services. By booking or using our services, you agree to be bound by these terms.

1. Definitions

  • "Company," "We," "Us," "Our" refers to Whelair, located at 1 Kim Seng Promenade, #02-14, Great World, Singapore 237994
  • "Client," "You," "Your" refers to the individual or entity booking our services
  • "Service" refers to our luxury car rental arrangements including Glimmer, Reflection, and Silhouette offerings
  • "Vehicle" refers to any automobile provided under our service arrangements
  • "Agreement" refers to the binding contract formed when you book our services

2. Eligibility and Agreement Formation

To use our services, you must:

  • Be at least 25 years of age
  • Hold a valid driver's license (for self-drive services) recognized in Singapore
  • Possess a valid credit or debit card for payment
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete information during booking

An agreement is formed when:

  • You submit a booking request through our website, phone, or email
  • We confirm your booking in writing
  • You accept the confirmed booking terms
  • Payment or deposit is received as specified

3. Service Description

Glimmer — Evening Arrival

3-5 hour chauffeur service with luxury sedan or grand tourer. Includes professional driver, vehicle waiting time, refreshments, and comprehensive insurance.

Reflection — Full-Day Drive

Full-day self-drive access (8:00 AM to 10:00 PM) with choice of vehicle types. Includes 300 km mileage allowance, insurance, roadside assistance, and concierge support.

Silhouette — Five-Day Arrangement

Five-day self-drive with personal consultation, vehicle selection or exchange option, 1,000 km mileage allowance, midpoint service refresh, and daily concierge access.

We reserve the right to substitute vehicles of comparable or superior quality if the selected vehicle becomes unavailable.

4. Booking and Payment

Reservation

Bookings are subject to vehicle availability and confirmation. We recommend booking at least 48 hours in advance, though we accommodate shorter notice when possible.

Payment Terms

  • Full payment is required at the time of booking confirmation
  • Accepted payment methods: Credit cards (Visa, Mastercard, American Express), bank transfer
  • All prices are in Singapore Dollars (SGD) and include GST where applicable
  • Payment receipts are provided upon request

Security Deposit

A refundable security deposit of SGD 1,500 is required for self-drive services. This deposit is held on your credit card and released within 7 business days after vehicle return, subject to inspection and any outstanding charges.

5. Modifications and Cancellations

Client-Initiated Changes

  • 48+ hours notice: Full refund or free modification
  • 24-48 hours notice: 50% cancellation fee; modifications subject to availability and potential surcharge
  • Less than 24 hours: No refund; modifications not guaranteed

Company-Initiated Changes

If we must cancel or significantly modify your booking due to vehicle unavailability or operational issues, we will offer a comparable alternative or provide a full refund.

6. Vehicle Use and Client Responsibilities

Permitted Use

  • Vehicles must be driven within Singapore unless regional travel is pre-approved
  • Only the named driver(s) on the agreement may operate the vehicle
  • Vehicles must be used in accordance with Singapore traffic laws
  • Commercial use, racing, or reckless driving is strictly prohibited

Prohibited Activities

  • Smoking inside vehicles
  • Transportation of illegal substances or items
  • Overloading beyond manufacturer specifications
  • Operating vehicle while under the influence of alcohol or drugs
  • Subletting or lending the vehicle to others

Vehicle Condition

You are responsible for maintaining the vehicle in good condition during the rental period. Any damage, theft, or loss must be reported immediately.

7. Insurance and Liability

Coverage Provided

All services include comprehensive insurance covering:

  • Vehicle damage (subject to excess)
  • Third-party liability as required by Singapore law
  • Theft protection

Excess and Exclusions

Insurance excess of SGD 3,000 applies to all claims. Coverage is void if:

  • Vehicle is driven by an unauthorized person
  • Driver is under the influence of alcohol or drugs
  • Damage results from prohibited activities
  • Required documentation is not provided

Client Liability

You are liable for all fines, penalties, and charges incurred during your rental period, including traffic violations, parking tickets, and toll charges.

8. Fuel and Mileage

  • Chauffeur services include fuel
  • Self-drive services: Vehicle provided with full tank; return with full tank or pay refueling charge plus service fee
  • Mileage allowances as specified in each service description
  • Excess mileage charged at SGD 0.80 per km

9. Accidents and Breakdowns

In the event of an accident or breakdown:

  1. Contact our 24-hour emergency line immediately
  2. Do not admit fault or liability
  3. Obtain contact and insurance details from other parties involved
  4. Report to Singapore Police if required by law
  5. Complete our incident report form within 24 hours
  6. Cooperate with insurance claim procedures

Roadside assistance is provided for mechanical failures. Charges may apply for incidents resulting from client negligence.

10. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Whelair and protected by Singapore intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Limitation of Liability

To the maximum extent permitted by Singapore law:

  • Our total liability for any claim shall not exceed the amount paid for the service
  • We are not liable for indirect, consequential, or punitive damages
  • We are not liable for delays or failures due to circumstances beyond our reasonable control
  • Services are provided "as is" without warranties beyond those required by law

12. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy and Singapore's Personal Data Protection Act. By using our services, you consent to our data practices as described in our Privacy Policy.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Singapore. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Singapore courts.

Before initiating legal proceedings, we encourage you to contact us to attempt informal resolution of any dispute.

14. Severability and Waiver

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15. Changes to Terms

We may update these Terms and Conditions periodically. Changes become effective when posted on our website. Continued use of our services after changes constitutes acceptance of the revised terms.

For significant changes, we will notify active clients via email.
